Telley Privacy Policy

Telley Inc ("Telley" "we," "our," or "us") respects your privacy rights and recognizes the importance of protecting your personal information. This Privacy Policy ("Privacy Policy") describes how we collect, use, and share personal data we receive from you when you access or use our services. This Privacy Policy also describes options we provide for you to access, update or otherwise take control of your personal data that we process. You acknowledge that this Privacy Policy is part of our Terms of Use, and by agreeing to use our services, you are agreeing to be bound by all of its terms and conditions and all applicable laws and regulations. If you do not agree to these terms, you are prohibited from using or accessing our services. Capitalized terms used herein but not otherwise defined have the meanings ascribed to them in the Terms of Use.

This Privacy Policy applies to all clients of Telley, and Visitors to the Sites. In the case of clients, client shall be responsible for (a) informing their customers ("End Users"), if any, of the existence of this Privacy Policy and (b) agreeing to this Privacy Policy, as amended, updated or modified from time to time, on behalf of his, her or its End Users.This Privacy Policy applies to all Personal Information we collect or receive from you when you use or access the Sites or when you interact with Telley, whether online, by phone, by mail, in person or by other means, in connection with inquiries, customer service, invoicing, and payment processing.

We and our agents, vendors, consultants, and other service providers (collectively, "Service Providers") may collect information you provide directly to us. For example, we collect information when you register an account, make a purchase, access our content, or otherwise communicate or transact with us.

The information we collect may include Personal Information and Customer Data as defined in the Terms of Use. "Personal Information" is information that can be used to identify you or other individuals by itself or when it is combined with other information, such as first and last name, e-mail address, postal address, and payment information, such as credit or debit card numbers, security code and expiration date.

Personal Information once "de-identified" or "aggregated" is not subject to this Privacy Policy and we and our Service Providers may treat it as non-Personal Information and use it without obligation to you except as prohibited by applicable law.

Information You Provide to Us

When creating an account or utilizing the Services you may provide Personal Information to us. This includes when you access the Sites, message with us, provide User Content, subject to the Terms of Use any applicable Additional Terms, which contains your Personal Information.

Account Information

When you create an Account, you provide information that could be Personal Information, such as your name, password and email address. You acknowledge that this information may be personal to you, and by creating an account on the Services and providing Personal Information to us, you consent to allowing others, including us, to identify you and therefore such Personal Information may not be anonymous. We may use your account information, which may include Personal Information, in a manner consistent with this Privacy Policy including to send you information about our Services. You may unsubscribe from these messages through your Account settings, although we, regardless, reserve the right to contact you when we believe it is necessary, such as for account recovery purposes.

Information Collected Automatically

We and our Service Providers may automatically collect certain information about you when you access or use the Services ("Usage Information"). Usage Information may include IP address, device identifier, browser type, operating system, data regarding network connected hardware, and information about your use of the Services. To the extent such Usage Information can be used to identify you personally, including if we combine Usage Information with other personally identifiable information, we will treat the combined information as Personal Information under this Privacy Policy.

We are not responsible for the accuracy of any information provided by third parties or third party policies or practices.

We may offer sweepstakes, giveaways contests, surveys, and other promotions (each, a "Promotion") jointly sponsored or offered by third parties that may require submitting Personal Information. If you voluntarily choose to enter a Promotion, your Personal Information may be disclosed to third parties for administrative purposes and as required by law (e.g., on a winners list). By entering, you agree to the Promotion Terms that govern that Promotion, and may, except where prohibited by applicable law, allow the sponsor and/or other parties to use your name, voice and/or likeness in advertising or marketing materials.

Our Services contain applications, content from and hyperlinks to websites, locations, platforms, and services operated and owned by third parties ("Third Party Services"). In addition, our Services contains features that allow you interact with, connect to, or access our Service through certain Third Party Services and third party devices ("Third Party Features"). For example, you interact with a Third Party Service when you "like" or "share" content over social media through our Services. Third parties may use Tracking Technologies to independently collect information about you and may solicit Personal Information from you. Also, if you use a Third Party Feature, both we and the applicable third party may have access to and use information associated with your use of the Third Party Feature.

Our Services may now or in the future contain Tracking Technologies operated by third parties. For example, analytics services, may use Tracking Technologies on our Service to help us analyze your use of the Services, compile statistic reports on the Services' activity, and provide other services relating to Services activity and internet usage.

The information collected and stored by third parties, whether through our Service, a Third Party Service, or a third party device, remains subject to their own policies and practices, including what information they share with us, your choices on their services and devices, and whether they store information in the U.S. or elsewhere. We are not responsible for and make no representations regarding third party policies and practices, and encourage you to familiarize yourself with and consult their privacy policies and terms of use. To the extent we combine information we receive from third parties with Personal Information we collect directly from you on the Service, we will treat the combined information as Personal Information under this Privacy Policy.

A. Accessing Your Information.

You may access, update, or remove certain account information that you have voluntarily submitted to us through the Service by sending an e-mail to us here. We may require additional information from you to allow us to confirm your identity. Please note that we will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

B. Tracking Technologies Generally.

Regular cookies may generally be disabled or removed by tools available as part of most commercial browsers, and in some instances blocked in the future by selecting certain settings. Browsers offer different functionalities and options so you may need to set them separately. Please be aware that if you disable or remove cookies some parts of the Services may not work and that when you revisit the Services your ability to limit browser-based Tracking Technologies is subject to your browser settings and limitations.

Your browser settings may allow you to automatically transmit a "Do Not Track" signal to online services you visit. Note, however, there is no industry consensus as to what site and app operators should do with regard to these signals. Accordingly, we do not monitor or take action with respect to "Do Not Track" signals or other mechanisms.

C. Communications.

You can opt out of receiving certain promotional e-mails from us at any time by following the instructions as provided in e-mails to click on the unsubscribe link or by sending an e-mail to us here with the word UNSUBSCRIBE in the subject field of the e-mail. Please note that your opt- out is limited to the e-mail address used and will not affect subsequent subscriptions or non-promotional communications, such as those about your account, transactions, servicing, or Telley' ongoing business relations.

This Section of our Privacy Policy applies solely to visitors and users who reside in the State of California.

The California Consumer Privacy Act ("CCPA") provides California residents with specific rights regarding their personal information. This section describes those CCPA rights and explains how to exercise those rights.

The business or commercial purposes for which we use the categories of information, including Personal Information, which we collect from us can be found in the "How We May Use Your Information" section above.

Your Rights Under the CCPA:

We may deny your deletion request if retaining the information is necessary for us to: (i) complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you; (ii) detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities; (iii) debug products to identify and repair errors that impair existing intended functionality; (iv) exercise free speech, ensure the right of another party to exercise their free speech rights, or exercise another right provided for by law; (v) enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us; (vi) comply with a legal obligation; or (vii) make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Your Rights under the CCPA

To exercise your Right to Know or Right to Delete, please submit a verifiable request to us by sending an email to support@telley.live.

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable request related to your Personal Information. The verifiable request must: (i) provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative; (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We may need to contact you to request additional information in order to verify you are the person about whom we collected Personal Information or that you are an authorized representative. We will not use any information provided as part of a request, including any contact information you provide or that we request in order to respond to or verify a request, for any purpose other than to respond to or verify your request.

We will make an effort to respond to your verifiable request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing either by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period before our receipt of the verifiable request. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights by (i) denying you goods or services; (ii) charging you a different price or rates for goods or services; or (iii) providing you a different level of quality of goods or service.

The Service is intended for a general audience and not directed to children under eighteen (18) years of age. Telley does not knowingly collect personal information from children under eighteen (18).

We take reasonable measures to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction. Nevertheless, transmission via the internet is not completely secure and we cannot guarantee the security of your information collected through our Service. Your Account information will be protected by a password for your privacy and security. You need to prevent unauthorized access to your Account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your Account.

We seek to protect Account information to ensure that it is kept private; however, we cannot guarantee the security of any Account information. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

In the event your Account and/or Personal Information is compromised, we will notify you promptly.

We are based in the U.S. and the information we and our Service Providers collect is governed by U.S. law. If you are accessing the Service from outside of the U.S., please be aware that information collected through the Service may be transferred to, processed, stored and used in the U.S. Data protection laws in the U.S. may be different from those of your country of residence and may be less protective of your information. Your use of the Service or provision of any information therefore constitutes your acknowledgment and consent to the transfer to and from, processing, usage, sharing and storage of your information, including Personal Information, in the U.S. as set forth in this Privacy Policy.

We reserve the right to revise and reissue this Privacy Policy at any time. Any changes will be effective immediately upon posting of the revised Privacy Policy. Your continued use of our Service indicates your consent to the Privacy Policy then posted. If the changes are material, we may provide you additional notice, to your e-mail address.
